The vGOLF App

The vGOLF Competition is exclusively available on the vGolf App or vGolf Website.

This app can be downloaded at no cost from the vGolf Website, Apple App Store, or Google Play Store.

Apple and Google are not sponsors or otherwise affiliated with any competition offered on the vGolf App.

Participation

Entry into the vGolf Competition requires Virtual Golf Balls, which can only be purchased through the vGolf Store.

Players can accumulate Virtual Golf Balls to redeem for E-Gift Cards or products available in the vGolf Store.

Professional golfers may redeem Virtual Golf Balls for Payid upon submission of their PGA Membership Number.

vGolf does not handle the reporting of Income Tax related to earnings from the competition.

The use of Virtual Golf Ball Tokens is governed by the vGolf Terms and Conditions

Privacy

All personal information collected via the vGolf App and Website is protected under the vGolf Privacy Policy.

Golf Rules

vGolf Competitions adhere to the Rules of Golf. Additionally, players must comply with the Local Rules set by the golf course where they are playing.

Handicap

vGolf Competitions utilize the Golf Australia Handicap System and are scored using the Stableford scoring system. This scoring system enables golfers of various skill levels to compete equitably.

Competition Rules

• How to Enter and Submit Scores
• To participate in a vGolf Competition Day, the entry fee is 1 Virtual Golf Ball.
• A vGolf Competition coincides with a Valid Round of Golf played on the same date as entered by the participant for that specific competition.
• A Valid Round of Golf is one completed at a golf club equipped with a Golf Link reporting system. The round must be validated at the end of the day on the participant’s Golf Australia Golf Link page.
• After completing their round, participants have until 7 PM on the same day to update their score in the vGolf App or Website. This includes entering their score and uploading a photo or screenshot of their scorecard for verification by vGolf.
• Failure to comply with these entry and score submission requirements results in disqualification from the competition and forfeiture of the Virtual Golf Ball used for entry.
• The Participant accepts and agrees with these Terms and Conditions by way of Entering the vGolf Competition of the Day.

Prize Distribution

After the competition concludes, the prize pool of Virtual Golf Balls will be distributed among registered users who have met all entry and participation requirements.

Acceptance and Binding Agreement

By utilizing the vGolf Services, you acknowledge and agree to these terms, thereby entering into a legally binding agreement with vGolf (“we” or “us”). This Agreement details your rights and obligations in using the vGolf Services. We collect and use information as outlined in our General Privacy Policy, which is incorporated by reference into this Agreement.

Prohibited Activities

You are prohibited from using third-party software to extract data from vGolf Services unless explicitly authorized by us. Facilitating, encouraging, or performing data extraction without our consent is strictly forbidden.

Use and Eligibility

You confirm that you have the authority to agree to these terms and are at least 18 years old, or have parental or guardian consent if under 18. If it is discovered that personal information from minors was collected without consent, it will be removed promptly.

Licenses

• vGolf Websites: We grant you a non-commercial, personal, non-transferable, and revocable license to access vGolf Websites.
• vGolf Mobile Apps: Similarly, you may download and use the vGolf Mobile App for personal use on your device.
• License Restrictions: These licenses are not transferable or assignable to third parties.

User Account and Registration

Access to certain vGolf Services may require registration. You must keep your access credentials confidential and not share them with others.

Term and Termination

This Agreement is effective upon your use of vGolf Services and continues until terminated by either party. We may terminate your access to the vGolf Services if you violate this Agreement or for any other reason.

Intellectual Property

We own all rights, titles, and interests in the vGolf Services. You may not modify, reverse engineer, or use our content outside the terms of this Agreement.

User Conduct

You must not misuse vGolf Services or engage in activities such as data harvesting, unauthorized linking, or attempts to interfere with our systems.

Content and Forums

Any content you provide through the vGolf Services is not considered confidential. You grant us the right to use your content as described in this Agreement.

Indemnification

You agree to defend and indemnify us against any claims related to your use of the vGolf Services or violation of this Agreement.

Disclaimers and Limitations of Liability

vGolf Services are provided “as is.” We disclaim all warranties, and our liability for any damages is limited to the greater of the amount you paid us or $10.

Jurisdiction

This Agreement is governed by the laws of Australia, and any disputes will be adjudicated in the appropriate court  in Victoria.

Modifications to Agreement

We may modify this Agreement at any time, with changes effective immediately upon posting.

Copyright Infringement

If you believe your copyright has been infringed upon by our services, please contact us with the required information.

Miscellaneous

This Agreement forming a legally binding contract with vGolf (“VG”). This Agreement regulates your access and use of the vGolf Services. VG’s practices regarding the collection and use of user information are detailed in our Privacy Policy, which is incorporated into this Agreement by reference.

Prohibited Uses

It is strictly forbidden for third-party software applications, including mobile apps, to extract or access any data from the vGolf Services without express permission from VG. Users must not enable or assist any third party, directly or indirectly, in extracting or accessing data from the vGolf Services unless such activities are expressly authorized by VG.

User Agreement

By using the vGolf Services, you agree to these terms and assert that you have the authority to enter into this Agreement. If you disagree with these terms, you should not access or use the vGolf Services. Users under the age of 18 must not provide personal information through the vGolf Services without parental or legal guardian consent. If VG discovers that personal information has been collected from a person under 18 without appropriate consent, it will be deleted.

License Terms

• vGolf Websites: Subject to this Agreement, VG grants you a limited, personal, non-commercial, non-exclusive, non-transferable, non-assignable, and revocable license to access vGolf Websites to which you have authorized access.
• vGolf Mobile Apps: VG grants you a similar license to download and use the vGolf Mobile App on your device solely for personal access to the services provided.
• License Restrictions: These licenses do not allow sublicensing or transfer by the user and are valid only during the subscription term.

Account and Registration

• Credentials: Access credentials are personal and should not be shared with others. “Registered User” refers to users who have access to the vGolf Services via username and password or other security measures.

Term and Termination

• Duration: This Agreement is effective while you use the vGolf Services or until VG terminates it.
• VG’s Rights: VG can modify, suspend, or discontinue any aspect of the vGolf Services at any time without notice. VG may also terminate or restrict your access if you violate this Agreement or for other reasons without liability.

Intellectual Property

• Ownership: VG retains all rights, title, and interest in the vGolf Services and associated intellectual property. Unauthorized use of any trademarks, copyrights, or proprietary information is prohibited.
• Client-side Code: You are licensed to use VG’s client-side code (such as JavaScript or mobile app code) solely for accessing the vGolf Services as permitted under this Agreement.

User Conduct

• Prohibitions: You must not engage in unauthorized use of the vGolf Services, including attempts to download, distribute, or modify any content without permission.
• Interactive Areas: Any information you disclose in public forums may become publicly accessible and you should protect sensitive information.

Miscellaneous

• Jurisdiction: The laws of Australia govern this Agreement. Any disputes will be adjudicated in Victoria, Australia.
• Amendments: VG may amend this Agreement at any time, effective upon notice, which may be given through various means including posting on the vGolf Services or via email.

By continuing to use the vGolf Services after any changes, you accept and agree to the amended terms.
